These Terms and Conditions ("Agreement") govern the participation in the Affcastle Affiliate Program ("Program") offered by Affcastle.com By joining the Program, you ("Affiliate") agree to abide by these terms and conditions.
  1. Program Overview
    1. The Program allows Affiliates to earn commissions by referring customers to Company's products or services.
    2. Upon acceptance into the Program, Affiliates will receive a unique affiliate link ("Affiliate Link") and may have access to additional marketing materials provided by the Company.
    3. Commissions will be paid based on qualifying actions, as determined by the Company, and in accordance with the Commission Structure outlined in section 3.
  2. Affiliate Eligibility
    1. Affiliates must be at least 18 years old and have the legal capacity to enter into a binding agreement.
    2. Affiliates must provide accurate and complete information when applying to the Program. The Company reserves the right to reject applications or terminate an Affiliate's participation for any reason.
    3. Affiliates must comply with all applicable laws and regulations, including but not limited to, privacy laws, anti-spam laws, and consumer protection laws.
  3. Commission Structure
    1. The Company will determine the commission rates and qualifying actions for each Affiliate, and such rates and actions may be subject to change at the Company's discretion.
    2. Commissions will be paid only for qualifying actions made through Affiliate Links.
    3. Commission payments will be made according to the payment schedule outlined by the Company.
  4. Affiliate Responsibilities
    1. Affiliates will be solely responsible for any and all expenses incurred in connection with their participation in the Program.
    2. Affiliates must not engage in any activity that may be deemed as fraudulent, misleading, or unethical, including but not limited to, creating false accounts, generating artificial clicks, or spamming.
    3. Affiliates must not engage in any form of direct competition with the Company or promote the Company's products or services on websites or platforms that violate the Company's policies.
    4. Affiliates must not use their Affiliate Links for their own purchases or for the purchases of individuals closely related to them.
  5. Intellectual Property
    1. The Company grants Affiliates a limited, non-exclusive, non-transferable right to use the provided marketing materials solely for the purpose of promoting the Company's products or services as part of the Program.
    2. Affiliates must not modify, reproduce, distribute, or create derivative works based on the Company's intellectual property without prior written consent.
  6. Termination
    1. Either party may terminate this Agreement at any time for any reason by giving written notice to the other party.
    2. The Company reserves the right to terminate an Affiliate's participation in the Program without notice if the Affiliate violates any provision of this Agreement or engages in any activity that may harm the Company's reputation or business.
  7. Limitation of Liability
    1. The Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or related to the Program or this Agreement.
  8. Miscellaneous
    1. This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings, whether oral or written.
    2. This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.
